Terms of service
These terms of service govern the use of the SoleVair online shop and every purchase made through it. Please read them before ordering; by placing an order you accept them.
1. Who we are
The SoleVair online shop is operated by Ronny Slotosch, sole trader, Jügesheimer Weg 32, 63500 Seligenstadt, Germany ("SoleVair", "we"). You can reach us by email at info@offen.de, by phone on +49 176 64148260 (Monday to Friday, 8:00 AM to 2:00 PM GMT/BST, UK time) or by post at the address above. SoleVair sells menswear online to customers in the United Kingdom.
2. Products
Product pages describe each item, the available colours and the available sizes. Minor colour deviations can occur because screens display colours differently. If you are unsure about anything on a product page, contact us before ordering and we will help.
3. Ordering and contract formation
You place an order by adding items to the cart and completing the checkout. After ordering you receive an order confirmation by email; the contract of sale is formed when we confirm your order. If we cannot fulfil an order - for example because an item is unavailable - we will tell you as soon as possible and refund any payment already taken.
4. Prices and payment
Prices shown in the United Kingdom market are in British Pounds (GBP) and include applicable taxes. Delivery is free; no additional charges are added by us at checkout. The payment methods available for your order are shown at checkout - currently credit and debit cards (the checkout shows Visa, Mastercard and Maestro), PayPal (which also allows card payment through PayPal's guest checkout) and the Shop Pay express option. 5. Delivery
We deliver free of charge, insured and with tracking. Orders placed by 1:00 PM GMT/BST (UK time) on a working day enter processing the same working day; processing takes 1-2 business days (Monday to Friday) and delivery a further 5-8 business days (Monday to Saturday), 6-10 business days in total. 6. Cancellation, returns and exchanges
You may cancel your purchase within 14 days of delivery without giving a reason, and exchanges of size or colour are free within the same period - the replacement is dispatched as soon as your exchange is registered. How returns are registered, who pays return costs and when refunds are issued is set out in the Refund policy; a model cancellation form is on the Withdrawal Form page.
7. Faulty goods and your statutory rights
We are legally obliged to supply goods that conform with the contract. If an item is faulty, damaged or not as described, the remedies in the Refund policy (section 7) apply and we cover the return costs. Nothing in these terms excludes or limits your statutory rights as a consumer, including under the Consumer Rights Act 2015.
8. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and in all other cases where liability cannot be limited by law. For slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. This clause does not limit the specific commitments we make in the Refund policy and Shipping policy for faulty goods, incorrect deliveries and lost or damaged parcels, and it does not limit your statutory consumer rights.
9. Intellectual property
All content in this shop - texts, images and layout - is protected by copyright and may not be reproduced or reused commercially without permission.
10. Governing law
These terms are governed by German law. If you order as a consumer with habitual residence in the United Kingdom, you additionally retain the protection of all mandatory consumer protection provisions of the law of your country of residence - including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 - and nothing in this clause deprives you of that protection.
11. Changes to these terms
We may update these terms from time to time, for example when our range or legal requirements change. The version published at the time of your order applies to that order.
12. Legal disclaimer
These terms have been prepared with care but have not been reviewed by a lawyer. If any provision of these terms is found to be invalid, the remaining provisions remain unaffected.
